Probation and Parole Violations in Wisconsin

Madison, Wisconsin Criminal Defense Lawyer

People accused of probation or parole violations are naturally scared of going to jail, or in some cases, going back to jail. The fact is that spending time in jail rarely if ever helps people reform themselves and become contributing members of society, and most judges and prosecutors are aware of that.

The  biggest  challenge  in  cases  involving  probation  and  parole  violation
cases  is  that  the  standards  of  evidence  are  lower  than  the  standards  in
a  regular  criminal  defense  matter.  In  other  words,  the  prosecution  is  not
required  to  convince  a  jury  "beyond  a  shadow  of  a  doubt"  that  a  violation was committed. In a normal criminal defense case the burden of proof is on the prosecution, in a parole or probation violation case the defendant must prove that the violation did not occur or that the violation should not result in a revocation of the defendant's probation or parole.

Each probation and parole violation case is unique

There are several variables in each parole or probation violation case. There is the original crime that resulted in the accused person's probation or parole. There is also the additional violation of the parole or probation. You must also consider the parole officer as well as the prosecuting attorney who have a significant amount of input. Then there is situation of the accused; are you gainfully employed? Have you showed up for all of your required follow up meetings? It is almost impossible to make any statements about parole and probation violations that will be meaningful to every situation. That is why I offer a free initial consultation to all probation and parole violation cases, as well as all criminal defense cases.
